What is Hindu Court Marriage?



A Hindu court marriage is a legal union between two individuals who are Hindus (including Buddhists, Jains, or Sikhs) solemnized and registered under the Hindu Marriage Act, 1955, in the presence of a Marriage Registrar (in court).

It provides legal recognition and proof of marriage.

 Eligibility Criteria

  • Religion: Both must be Hindu, Sikh, Jain, or Buddhist (by birth or conversion).

  • Age: Groom – minimum 21 years; Bride – minimum 18 years.

  • Marital Status: Both should be unmarried, divorced, or widowed.

  • Mental Status: Both should be of sound mind and capable of giving valid consent.

  • Prohibited Relationship: They must not be related within the prohibited degrees of relationship unless permitted by their custom.

 Required Documents

  • Identity Proof (Any one): Aadhaar Card, Passport, Voter ID, Driving License.
  • Age Proof: Birth Certificate, 10th Marksheet, Passport.

    Address Proof: Aadhaar Card, Voter ID, Ration Card, Electricity/Water Bill.

    Passport-sized photographs: 6–8 each.

    Affidavits (from both parties) stating:

    • Date of birth

    • Marital status

    • Nationality

    • Willingness to marry

  • Religion Proof (if converted, conversion certificate).

    Witnesses: 2–3 witnesses with ID proofs.

    Divorce/Death Certificate (if applicable).
