Options for Proof of Live-in Relationship

1. Live-in Relationship Affidavit (Most Common)

  • Drafted on a stamp paper and notarized by a Notary Public.

  • Contains:

    • Names, ages, and addresses of both partners

    • Statement that both are living together out of free will

    • Duration of cohabitation

    • Acknowledgment that they are not legally married but cohabiting

  • This is the most widely accepted proof for live-in relationships (for banks, rental agreements, police verification, visa purposes in some cases).

Live-in Relationship Agreement

  • A private legal contract prepared by a lawyer.

  • Covers:

    • Financial arrangements

    • Property ownership

    • Child custody (if any in future)

    • Mutual consent to live together without legal marriage

  • Works as a legal safeguard in case of disputes.


Supporting Documents

Sometimes couples use these as indirect proof:

  • Joint rental agreement / lease in both names

  • Joint bank account / nominee in each other’s insurance/policies

  • Affidavit for address proof with both names

  • Police verification letter (if applied for protection)


Legal Status of Live-in in India

  • Live-in relationships are not illegal in India.

  • The Supreme Court has recognized them under Article 21 (Right to Life & Liberty).

  • Under the Protection of Women from Domestic Violence Act, 2005, women in live-in relationships have rights (maintenance, protection from abuse).

  • Children born out of live-in are considered legitimate.


A “certificate” per se is not issued by the government, but an affidavit/agreement notarized by an advocate serves as the equivalent legal proof.
